Study UK has teamed up with leading professional services firm, Deloitte LLP, to explore a hot topic that may have a significant impact on all institutions that use overseas educational agents: whether VAT is payable on their commission fees. We'll take a look at the evolving situation with HMRC and provide best-practice advice to help you prepare.
This event is recommended for all financial managers at any UK education provider that:
(i) considers that its supplies of education are exempt from VAT; and
(ii) receives services from any non-UK based persons (e.g. overseas agents).
Potential VAT registration & UK VAT liability?
Many UK education providers are not registered for VAT, on the basis that their supplies of education qualify for VAT exemption. However, where UK based education providers receive services from outside the UK, this may trigger a UK VAT registration requirement, as well as generating a VAT cost in the UK.
Examples of such services are those received from overseas agents. This is because, as the recipient of the services, the UK education provider will, in most cases, be required to self-account for UK VAT on the supplies received. This in itself can trigger a VAT registration liability and generate a VAT cost.
